Wills for the disabled

Like us all, those with disabilities are advised to write a will.

There may be occasions where people who suffer from a form of disability may find it difficult to sign a will. Solicitors and will writers are experts at making a provision for those affected by making a mark. However there are very strict safeguards which have to be adhered to when a will is signed by someone other than the testator.


The main thing to consider is that a will can not be made by anyone who does not possess sufficient mental capacity to fully understand what they are doing. Therefore any one making a will should possess full mental capacity.

a will made by someone who does not have full mental capacity can be challenged and ultimately set aside.If there is any doubt as to someones capacity a doctors advice should be sought and they have certified that they have sufficient mental capacity.

By the same token, a will can not be witnessed by someone without full mental capacity.
